Commuter vows to fight the fine

A furious commuter has had an appeal against a parking fine rejected '“ despite providing evidence that he had a valid ticket displayed on the dashboard.

Julian Nutley says he left his car at Leighton Buzzard Railway Station on Tuesday, May 24, paid £7.90 for his parking ticket and displayed it correctly.

But when he returned to the vehicle later that day he was bemused to find a parking charge notice had been issued by Indigo Park Solutions,.

He said: “I was surprised to return to my car to see a penalty notice stuck to the side.

“Thinking it must have been a mistake I spent time emailing evidence, including the ticket and photographs to Indigo, who then to my surprise rejected my appeal.

“I have phoned them and emailed them but they refuse to listen to reason and I now have to appeal to POPLA.

“I think is it bewildering how they can reject my appeal after I have shown them the evidence of the valid ticket and it being displayed on the windscreen.

“I really feel they are trying to scare people into a fine of £100 even though the ticket should never have been issued.

“I think they are hoping that people will just give up and pay the fine, but I refuse to do that. I paid for the ticket and displayed it so I will continue to fight the fine.”

Mr Nutley’s appeal against the fine was rejected by Indigo. In a letter to Mr Nutley, they said that his vehicle was in breach of the terms and conditions of parking which are displayed at the entrance to the car park.

The letter quotes: “Breach Code 1: Failing to display a valid ticket or voucher.”

A spokesperson for Indigo Park Solutions told the LBO: “Customers must display a valid parking ticket.

“If they don’t, they may be issued with a parking charge notice.”

Mr Nutley has confirmed he has now appealed to the Parking On Private Land Appeal Service (POPLA) and is awaiting the decision.
